LVW Attorneys Continue to Lead the Fight for Justice for Victims of Nursing Home Neglect

Leitner Varughese Warywoda attorney Justin Varughese was recognized on Telemundo 47 (New York) as the firm continues efforts leading the fight for justice for the families of more than 12,000 nursing home residents who died in New York nursing homes from COVID. Watch the media coverage here.

Last week, controversy erupted in all major news outlets over whether New York Gov. Andrew Cuomo's administration knowingly undercounted deaths among nursing home residents during the height of the Covid-19 pandemic in the state. Video footage was leaked showing top aide for the governor apologizing to Democratic lawmakers, saying the administration "froze" when initially asked by state legislators back in August about the issue, in response to a report released last month by New York Attorney General Letitia James which suggested that Cuomo's administration undercounted deaths among nursing home residents by as much as 50%. The Cuomo aide told Democratic lawmakers that the administration took months to release data on the coronavirus death toll among nursing home residents because officials “froze” over worries the information was “going to be used against us.

Telemundo 47 reported that New York State senators called for an investigation to clarify deaths of elderly in New York nursing homes, while legislators denounced that Governor Cuomo "lied" to New Yorkers about the deaths of the elderly. They ask for an investigation to check 'if there was crime'.

Several New York lawmakers, headed by Ron Kim of Queens, are demanding legislative action to protect vulnerable nursing home residents, including repealing immunity for nursing homes, launching a victims compensation fund and authorizing a bipartisan commission with subpoena power to investigate COVID-19 outbreaks at long-term care homes.
