Leitner Varughese Warywoda Recovers the 15th Largest Settlement Injury in New York

In this action for motor vehicle negligence, the 84-year-old plaintiff pedestrian contended that the defendant driver negligently traveled in reverse and through an intersection as the defendant attempted to obtain a parking spot that was near a bus stop. The plaintiff contended that as a result, he was struck and sustained a closed head injury and difficulties with concentration, short-term memory and balance. The plaintiff was an impatient for approximately one month. He continued therapy for approximately one year and ultimately made a relatively good recovery. The defendant maintained that the plaintiff was negligent in stepping into the roadway.


The plaintiff would have countered that stepped into a bus stop to be able to observe if a bus was approaching, and the plaintiff would have asserted that in view of the actions of the defendant driver, who traveled in reverse for some distance and through an intersection, it was clear that the defendant acted in a very negligent manner, causing the collision.


The plaintiff suffered a closed head injury and intraparenchymal hemorrhage. Following the approximate one-month in-patient hospitalization, the plaintiff required extensive therapy, including PT to address his balance issues. The therapy continued for approximately one year. The plaintiff maintained that although he ultimately made a relatively good recovery, he will permanently suffer some difficulties with short term memory, concentration and balance.
