LVW Partner Nicholas Warywoda Univision Interview Discussing Filing of Coronavirus Death Lawsuit


Nicholas Warywoda, a Partner with Leitner Varughese Warywoda in New York, was interviewed by Spanish language television station Univision Nueva York related to the filing of the first COVID-19 related negligence and death lawsuit against Long Island nursing home Our Lady of Consolation Nursing & Rehabilitative Care Center. This facility has the highest death count in Suffolk County as per the Department of Health. The full story can be seen here.


It was alleged that that despite warnings from health authorities before the pandemic, the nursing home failed to take the necessary precautions to protect patients. This facility, Our Lady of Consolation, was cited with violations 31 times in the years prior to the coronavirus pandemic, including for failure to have proper infection control procedures.


Vivian Zayas, who brought her mother to Our Lady of Consolation Nursing & Rehabilitative Care Center in West Islip, filed the lawsuit following the death of her 78-year-old mother, Ana Celia Martinez. Martinez was one of 39 patients who died of the coronavirus at the nursing home, according to state records. Leading up to and during the coronavirus pandemic, the nursing home failed to isolate residents known or suspected to have the virus, according to the lawsuit.
